Welcome to Small Group Soccer Training ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your access to and use of our website, services, and any related content (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions contained herein, you may not access or use our Services.

Small Group Soccer Training provides professional soccer training services in Raleigh and Wake County, North Carolina. Our Services include small group training sessions, coaching, feedback, and related soccer instruction. These Terms apply to all users of our Services, including but not limited to players, parents, guardians, and spectators.

Please read these Terms carefully before using our Services. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

User Agreements

Eligibility

To use our Services, you must be at least 18 years of age or have the consent of a parent or legal guardian. If you are under 18, your parent or legal guardian must agree to these Terms on your behalf. By using our Services, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.

Parents and guardians who consent to their child's participation in our Services acknowledge that they have read and agree to be bound by these Terms. They further acknowledge that they are responsible for supervising their child's participation and ensuring compliance with all applicable rules and safety guidelines.

Account Responsibility

You are responsible for maintaining the confidentiality of any account information and passwords you create in connection with our Services. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

You agree to provide accurate, current, and complete information when creating an account or registering for our Services. You are responsible for updating this information to keep it accurate and current. We reserve the right to suspend or terminate your account if we believe any information provided is inaccurate or incomplete.

Payment and Fees

Our Services may require payment of fees. All fees are stated in U.S. dollars and are exclusive of applicable taxes. You agree to pay all fees and charges that you incur in connection with your use of our Services. Payment must be made according to the payment terms specified at the time of purchase.

We accept various payment methods as indicated on our website. By providing payment information, you authorize us to charge your chosen payment method for the fees owed. If a payment cannot be processed, we may suspend or terminate your access to our Services until payment is received.

Refund policies are available upon request and are subject to the terms specified at the time of purchase. No refunds will be issued for sessions that have been completed or for cancellations made less than 24 hours before a scheduled session, except as required by law or at our sole discretion.

Assumption of Risk

You acknowledge that participation in soccer training involves inherent risks of physical injury, including but not limited to sprains, strains, fractures, and other injuries. By participating in our Services, you voluntarily assume all risks associated with your participation. You agree that you are physically fit and capable of participating in the training activities offered.

If you have any medical conditions, injuries, or physical limitations that could affect your ability to safely participate in our Services, you must disclose this information to us before beginning training. We reserve the right to modify your training program or restrict your participation based on health and safety considerations.

Acceptable Use Policy

Prohibited Conduct

You agree not to engage in any conduct that violates these Terms or applicable law. Prohibited conduct includes but is not limited to:

  • Harassing, threatening, or abusing other participants, coaches, or staff
  • Discriminating against or showing prejudice toward others based on race, color, religion, gender, sexual orientation, or other protected characteristics
  • Engaging in violent, aggressive, or dangerous behavior
  • Using profane, obscene, or offensive language
  • Violating any applicable laws or regulations
  • Interfering with the operation of our Services or the rights of other users
  • Attempting to gain unauthorized access to our systems or networks
  • Uploading or transmitting viruses or malicious code

Code of Conduct

All participants are expected to conduct themselves with respect, integrity, and sportsmanship. This includes treating coaches, fellow participants, and staff members with courtesy and respect. We maintain a zero-tolerance policy for bullying, harassment, or discriminatory behavior.

Participants must follow all instructions provided by coaches and staff members. Failure to comply with reasonable instructions or violations of our Code of Conduct may result in suspension or termination of your participation in our Services.

Equipment and Safety

Participants are responsible for providing appropriate soccer equipment, including proper footwear and athletic clothing. We recommend that all participants wear shin guards and other protective equipment as appropriate for the training activities. Participants with long hair should tie it back to prevent injury.

Participants must follow all safety guidelines and instructions provided by our coaches. Failure to comply with safety requirements may result in exclusion from training sessions. We are not responsible for injuries resulting from failure to follow safety guidelines or use of improper equipment.

Limitation of Liability

Disclaimer of Warranties

Our Services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or secure.

We do not guarantee any specific results from participation in our training Services. Individual results vary based on factors including but not limited to effort, natural ability, prior experience, and consistency of participation.

Limitation of Damages

To the fullest extent permitted by law, Small Group Soccer Training shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, even if we have been advised of the possibility of such damages. This includes but is not limited to damages for loss of profits, loss of revenue, loss of data, or loss of use.

In no event shall our total liability to you exceed the amount you have paid to us for Services in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of these limitations may not apply to you.

Release of Liability

By participating in our Services, you agree to release and hold harmless Small Group Soccer Training, its owners, operators, coaches, staff, and agents from any and all claims, damages, liabilities, and expenses arising from your participation, including but not limited to claims arising from injuries sustained during training.

This release applies to all claims known and unknown, and includes claims for negligence. If you are under 18, your parent or legal guardian agrees to this release on your behalf.

Insurance

We recommend that all participants maintain personal health insurance coverage. Small Group Soccer Training does not provide medical insurance for participants. In the event of injury, participants and their families are responsible for medical expenses not covered by their personal insurance.

Intellectual Property Rights

All content on our website and in our Services, including but not limited to text, graphics, logos, images, videos, and software, is the property of Small Group Soccer Training or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view our Services for personal, non-commercial use only. You may not reproduce, distribute, transmit, display, or perform any content from our Services without our prior written consent, except as necessary to view the content on your device.

You agree not to remove or alter any copyright, trademark, or other proprietary notices from our Services. Any unauthorized use of our intellectual property may violate copyright, trademark, and other applicable laws.

Indemnification

You agree to indemnify, defend, and hold harmless Small Group Soccer Training and its owners, operators, coaches, staff, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to your use of our Services, your violation of these Terms, or your violation of any applicable law or regulation.

This indemnification obligation applies to all claims, known and unknown, and survives the termination of these Terms and your use of our Services.

Termination

We reserve the right to terminate or suspend your access to our Services at any time, with or without cause, and with or without notice. Causes for termination include but are not limited to violation of these Terms, non-payment of fees, or conduct that we believe is harmful or inappropriate.

Upon termination, your right to use our Services ceases immediately. We are not liable for any consequences of termination, including but not limited to loss of access to training sessions or account information.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the jurisdiction and venue of such courts.

Dispute Resolution

Before initiating any legal action, you agree to attempt to resolve any dispute with us informally by contacting us and providing a detailed description of the issue. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

These Terms, together with any other agreements or policies referenced herein, constitute the entire agreement between you and Small Group Soccer Training regarding your use of our Services and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver must be in writing and signed by both parties to be effective.
